Non-life insurers are open to recognizing the traffic investigation reports of Metropolitan Manila Development Authority (MMDA) personnel but only if other government agencies, including courts, will finally accept these for claims payments.
In a recent interview, Philippine Insurers and Reinsurers Association chair Michael F. Rellosa said that non-life insurance companies did not have a problem with using MMDA reports to settle the claims of vehicle owners involved in road accidents.
The MMDA earlier said that “the nonrecognition of [its] reports in insurance claims was one of the reasons for traffic buildup during accidents.”
Rellosa, however, pointed out that when these cases end up in court, only police reports were considered official documents under the law.
He said that government agencies, including the Insurance Commission and judiciary, decide with finality if MMDA reports could be considered official documents. –Ben O. de Vera
